The Be Inspired. No Ordinary Burger! Contest ("Contest") begins on June 15, 2011, at 12:00 a.m. ET and ends on September 6, 2011, at 11:59 a.m. ET ("Contest Period").
HOW TO ENTER: Visit the Johnsonville website (www.johnsonville.com/burgercontest) (the "Website") during the Contest Period to access the Contest Entry Form. Complete Contest Entry Form, including your original burger "recipe" using either Johnsonville® Bratwurst Patties or Johnsonville Italian Sausage Patties ("Recipe"). All recipes must be composed of grilled or fully cooked Johnsonville Bratwurst or Italian Sausage patties served as a sandwich on buns or other sandwich bread type item (such as ciabatta, biscuits, or focaccia). Recipe may include any combination of condiments (such as ketchup, mayonnaise, salsa, and mustard), sauces or spreads (such as pesto , barbecue or hot sauce), cheeses, and toppings (such as sauerkraut, jalapenos, onions, tomatoes, avocados, and lettuce). Every component of the burger recipe must be placed between the bun or bread pieces, or served open-faced on a bread product. You must indicate the appropriate recipe category: Bratwurst Patties or Italian Sausage Patties ("Recipe Category"). The Recipe must meet the Entry Requirements listed below. You must also include a name for your Recipe. You may also include a photo of your Recipe (optional). Photos must be submitted in .jpg, .gif, or .png format (5MB maximum). Photos will not be judged, but will be posted as part of the Consumer's Choice Contest if submitted. Collectively, the Recipe, name of your Recipe and Photo (if included) are referred to as the "Entry". To submit your Entry, you must agree to these Official Rules and then click "Submit Entry." Limit one entry per person/e-mail address, per category. Multiple entries in one category will invalidate all entries from the entrant. All materials submitted become the property of Johnsonville Sausage ("Sponsor") and none will be returned. Submission of an Entry grants Sponsor and its agents the right to publish, use, adapt, edit and/or modify such Entry and all components thereof in any way, in any and all media, without limitation, and without consideration to the entrant.
ENTRY REQUIREMENTS: The Recipe must be an original work created by the entrant and cannot have previously won a contest or other promotion. Recipe must use at least one (1) Johnsonville Bratwurst Patty or one (1) Johnsonville Italian Sausage Patty and can be entered in only one category. Recipe must not have been previously published, must not be awaiting publication, nor may be submitted for publication consideration during the period of the Contest. Recipes must be in English and list all ingredients in exact common U.S. household measurements in order of use, step-by-step preparation instructions and cooking times. The Recipe name may not include any person's name or brand, including the Johnsonville brand. Recipes may not include any brand name ingredients or trademarks, except for Johnsonville Sausage.
ELIGIBILITY: The Contest is open to legal residents of the 50 United States and D.C., 18 years of age or older. Employees, officers and directors of Sponsor, Wal-Mart, the National Pork Board, their respective affiliates, subsidiaries, distributors, sales representatives, website developers and administrators, retailers, advertising, sales promotion and judging agencies and all other service agencies involved with the Contest, and members of the immediate families (parent, child, sibling and spouse of each) or households of any of the above are not eligible. The Contest is open only to amateur home cooks. No Professional Chefs (as hereafter defined) may enter. "Professional Chef" is defined as any person who has received compensation as a source of income for his/her cooking.
INITIAL JUDGING: Recipes will be judged by a qualified panel of judges and assigned points based on the following criteria and point system: perceived taste (1-50 points); creativity (1-25 points); ease of preparation (1-25 points). The Recipes with the top three (3) scores in each Recipe Category will determine the three finalists in each category ("Finalists"), subject to the results of the Consumers' Choice Contest (see below), which will knock out the lowest scoring Finalist in the category from which the Consumers' Choice winner is selected. In the event of a tie, the Entry with the higher "taste" score will be declared the Finalist. If Entries are still tied, the Entry with the higher score for "creativity" will declared the Finalist. If a tie continues, the tied entries will be re-judged by a new judge using the original criteria. The potential Finalists will be chosen on or about, September 9, 2011 and notified via telephone, email or mail. Finalists are subject to eligibility verification.
CONSUMERS' CHOICE CONTEST: Recipes and photos (if submitted) will be posted on the gallery on the Website as they are submitted and approved, and visitors will be asked to vote for their favorite Recipe in each category during the Contest Period. Limit one vote per person per category per day. Automated methods of voting are prohibited. Use of any automated system to circumvent the limit on the number of votes is prohibited and will result in such votes being void and may result in disqualification of the Entry received such votes, at Sponsor's sole discretion. One (1) Consumers' Choice winner will be selected based on the total number of votes received. The winner of the Consumers' Choice Contest for will be deemed to be a Finalist in the category for which the Recipe was submitted and will replace the lowest scoring Finalist (based on the initial judging above) for that category.
FINAL JUDGING EVENT: Finalists will be announced to the public on or about September 9, 2011. Finalists will be required to attend the final judging event in Bentonville, Arkansas on or about October 2, 2011, at a location to be selected by Sponsor. At the final judging event, one at a time and in random order, each Finalist will briefly demonstrate the preparation process for their Recipe and answer questions from the judging panel. Sponsor will make best efforts to provide all ingredients and cooking equipment (such as appliances, utensils, etc.) needed to successfully demonstrate how to prepare the Recipe at the final judging event. Sponsor reserves the right to substitute comparable ingredients at its discretion. Following the Recipe preparation demonstration, each dish will be tasted and scored by a qualified judging panel based on the following criteria and point system: taste (1-50 points); creativity (1-25 points); ease of preparation (1-25 points). After the final judging is completed, the Finalist with the most points in each Recipe Category will be declared a Grand Prize winner. In the event of a tie, the same tie-breaking procedure set forth above will be used to determine the Grand Prize winner. If a Finalist is unable to participate in the final judging event, his/her status as a Finalist and Finalist Prize will be forfeited and an alternate Finalist will be selected, if circumstances permit. The Sponsor will provide round-trip coach airfare for each Finalist and one guest from the major airport nearest the Finalist's U.S. residence to Bentonville, Arkansas and hotel accommodations (double occupancy) for two nights for each Finalist and his or her guest. If the Finalist lives within a reasonable driving distance of Bentonville, alternate transportation to the event may be provided by the Sponsor. All other expenses related to travel to the final judging event are the responsibility of Finalist and his or her guest. If Finalist is an eligible minor, he/she must be accompanied by a parent or legal guardian.
PRIZES: Two (2) Grand Prizes (one (1) prize in each Recipe Category): a one year supply of groceries, awarded as twelve (12) $500 Wal-Mart Gift Cards. Approximate Retail Value ("ARV"): $6,000, each. Total ARV: $12,000. Grand Prize winners' Recipes will be featured on Johnsonville Bratwurst Patties or Johnsonville Italian Sausage Patties packages along with winner's name and photo. Prizes not redeemable for cash and no substitutions will be made, except by Sponsor who may substitute a prize of equal or greater value. All prizes will be awarded provided they are properly claimed in accordance with these Official Rules and a sufficient number of eligible entries are received and provided further that circumstances permit. Limit one prize per person, household, or family.
GENERAL TERMS & CONDITIONS: Sponsor's decisions will be final on all matters relating to this Contest. Each potential Finalist and his or her guest will be required to execute an Affidavit of Eligibility, Assignment of Rights, Liability Release and (where legal) a Publicity Release. If potential Finalist or guest fails to return such documents within seven business days, or the potential Finalist is found to be ineligible, or if he/she does not comply with these Official Rules, then the potential Finalist will be disqualified and an alternate Finalist will be selected, if circumstances permit. Finalists will also have to make themselves available for media interviews and public relations activities if appropriate. If Finalist notifications are returned as undeliverable, this will result in disqualification and an alternate winner will be selected, time permitting. Prizes are non-transferable. No cash redemptions or substitutions permitted, except by Sponsor who may substitute a prize of equal or greater value if the featured prize or any portion thereof becomes unavailable. Winners are solely responsible for any federal, state or local taxes on prizes. All federal, state and local laws and regulations apply. Except where prohibited by law, Finalists agree to permit the Sponsor to use Finalist's name, photograph and likeness, Recipe/name (in whole, in part or altered in any way), biographical information, voice, video, and city and state on a worldwide basis, and in all forms of media, in perpetuity, without further compensation (collectively "Publicity Materials"). Finalists must irrevocably assign and transfer to the sponsor any all rights, title and interest in the Entry, including, without limitation, all copyrights as a condition of being declared a Finalist and the opportunity to win a Grand Prize. Finalists Winners hereby waive any right to inspect and approve finished Publicity Materials, and Finalists and Winner will not hold Sponsor responsible for any liability resulting from the use of the Publicity Materials. All Publicity Materials developed or used hereunder will be and remain the property of Sponsor and/or Wal-Mart. All participants, Finalists and Winner also agree to release, discharge, indemnify and hold harmless Sponsor, Wal-Mart, their respective affiliates and subsidiaries, and each of their respective officers, directors, employees, representatives and agents from and against any claims, damages or liability due to any injuries, damages, or losses to any person (including death) or property of any kind resulting in whole or in part, directly or indirectly, from acceptance, possession, misuse or use of any prize or participation in any Contest-related activity or participation in this Contest. The Sponsor may prohibit any entrant from participating in the Contest at its sole discretion, if an entrant shows a disregard for these Official Rules or acts: (a) in a manner Sponsor determines to be unfair or inequitable, including but not limited to tampering with the Contest or the Contest website; (b) with an intent to annoy, threaten or harass any other entrant or the Sponsor; or (c) in any other disruptive or illegal manner. Sponsor reserves the right in its sole discretion to cancel, terminate, modify or suspend this Contest should electronic viruses, other malicious software attacks, unauthorized human intervention, systems malfunctions, failures, difficulties or other causes beyond the control of the Sponsor and its agencies corrupt or affect the purpose, administration, security, fairness or proper play or conduct of the Contest. In such event, Sponsor will conduct the Contest in accordance with these Official Rules in a manner deemed fair, proper and equitable by Sponsor, in its sole discretion. By entering, entrants agree and consent: (a) that all issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, participant's rights and obligations, or the rights and obligations of the Sponsor in connection with the Contest, will be governed by, and construed in accordance with, the laws of State of Wisconsin, without giving effect to any choice of law or conflict of law rules, and (b) to the jurisdiction and venue of the federal, state and local courts located in Madison, Wisconsin with respect to any such claim or issue.
LIMITATIONS OF LIABILITY: In the event of a dispute regarding the identity of an entrant, such entry will be deemed to be made by the authorized account holder of the e‑mail address submitted at the time of entry. "Authorized account holder" is deemed as the natural person who is assigned to an e‑mail address by an Internet access provider, service provider or other online organization that is responsible for assigning e‑mail addresses for the domain associated with the submitted e‑mail address. Neither Sponsor nor its agencies are responsible for lost, late, stolen, illegible, misdirected, or non-delivered entries or e-mail; or for lost, interrupted or unavailable satellite, network, server, Internet Service Provider (ISP), website or other connections availability, accessibility or traffic congestion, or miscommunications, or failed computer, network, telephone, satellite, or cable hardware, software or lines, or technical failure, or jumbled, scrambled, delayed, or misdirected transmissions, or computer hardware or software malfunctions, failures or difficulties, or other errors of any kind whether human, mechanical, electronic or network, or the incorrect or inaccurate capture of entry or other information or the failure to capture, or loss of, any such information. Neither Sponsor nor its agencies are responsible for any incorrect or inaccurate information, whether caused by website users, or by any equipment or programming associated with or utilized in the Contest and assume no responsibility for any error, omission, interruption, deletion, defect or delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or tampering with or hacking of the Sponsor's website. Sponsor reserves the right, at its sole discretion, to disqualify any individual it finds may be tampering with the entry process or operation of the Contest or the Sponsor's website, may be acting in violation of the terms of the Sponsor's website or these Official Rules or may be acting in a non-sportsmanlike or disruptive manner, or with intent to threaten, abuse or harass any other person. Any attempt to deliberately damage any website or undermine the legitimate operation of the Contest is unlawful and subject to legal action by Sponsor or its agents.
